Secretary, DIMIA [2005] FCA 549, where the Government failed to meet its duty of care towards two detainees suffering severe mental illness, raises many issues. Whilst the entire policy of mandatory long-term detention is at the heart of the problems, one aspect of the policy that is currently very relevant but has received little attention is the outsourcing of the management of immigration detention."
